Belarus: Regime Still Raiding, Jailing Labor and Democracy Activists

Belarus has become “a conveyor belt of torture against political prisoners,” where worker and human rights activists face daily raids, arrests and lengthy prison terms for fighting for democracy and the right to freedom of association, said the wife of a leading dissident last week. 

Natallia Pinchuk, whose husband is Nobel laureate and human rights activist Ales Bialiatski, visited the Solidarity Center and spoke to staff about her husband’s imprisonment and the Belarus government’s repression of trade union activists. 

Known for his leadership of the Viasna Human Rights Center–which he founded in 1996 to support political prisoners and their families–Bialiatski is currently serving a 10-year prison sentence at a brutal penal colony in Horki for receiving international financial support for the organization. He was among a dozen activists the Belarus regime arrested in July 2021 during raids of activists’ homes and the offices of civil society organizations. 

“Ales represents the tragic situation of political prisoners in Belarus,” Pinchuk said. She added that the government imprisons 10 to 15 people every day, a considerable number for such a small country, and still conducts raids against and imprisons union activists.

Pinchuck said she has been unable to get information on Bialiatski’s condition since he was placed in solitary confinement in October. He is ill, requiring daily medication that Pinchuk cannot provide to him because political prisoners are prohibited from receiving outside materials. Compounding the situation, political prisoners face violence perpetrated by prison officials. 

“Political prisoners are beaten in showers. Other prisoners beat them regularly, and prison officials are instigating those beatings,” she said.

Belarus’ president, Alexander Lukashenko, has held power since 1994. In 1996, he changed the constitution to consolidate power in the office of the president, which sent thousands of Belarusians into the streets in protests that were violently suppressed. He later claimed a landslide victory in August 2020, sparking widespread claims of fraud and massive protests and strikes. Lukashenko’s regime responded to the 2020 protests with ruthless repression, leading to deaths, injuries and over 10,000 arrests. 

The International Trade Union Confederation has ranked Belarus among the 10 worst countries in the world for workers in its 2023 Global Rights Index, citing the forced dissolution of unions and targeted arrests and imprisonment of trade unionists. More than 30 trade union activists are imprisoned in Belarus because they fought for workers’ rights. Others, in danger and unable to work, live in exile abroad.

The Philippines Ratifies Treaty to Eliminate Violence, Harassment at Work

This week, the Philippines became the first Asian country to ratify the International Labor Organization (ILO) Convention No. 190, in a unanimous vote in the Philippine Senate. ILO C190, or the “Convention Concerning the Elimination of Violence and Harassment in the World of Work,” aims to protect all workers from all forms of violence, regardless of their workplace and employment status, and with the inclusion of a responsive approach to gender-based violence and harassment.

The Philippine labor movement campaigned and lobbied for ratification over the last year, most recently holding a press conference with global union federation affiliates and attending a Senate committee hearing on the convention. 

The victory is a crucial step in the movement’s campaign to end violence and harassment in the world of work, particularly in regard to the right to organize and collectively bargain. Philippine unions organize workers and fight for their rights amid killings, illegal arrests, red-tagging, union busting and other freedom of association violations. And for their “resilience, persistence and courage in the face of extreme violence and repression,” they received the AFL-CIO’s top human rights award last week.

The Solidarity Center works with trade unions, global union federations and allied organizations to support advocacy and union organizing that advance labor rights and freedom of association in the Philippines. It also supports Women Workers United, a coalition of women worker groups from different trade unions.

For their courage and persistence in the face of escalating threats to their own lives, seven delegates representing the Philippine labor movement received the 2023 AFL-CIO George Meany-Lane Kirkland Human Rights Award in a ceremony in Washington, D.C., this week. The award is given annually in recognition of dedication to and effectiveness in highlighting the widespread denial of fundamental human rights at work and in society.

“This award is in recognition of the Philippines labor movement’s resilience, persistence and courage in the face of extreme violence and repression,” said AFL-CIO President Liz Shuler at the event.

More than 70 union members have been killed since 2016, and many more are victims of red-tagging (branding and accusing individuals and/or organizations of being terrorists), illegal firing of union activists and anti-terrorism laws directed at stifling freedom to form unions and bargain.

“The killings are precisely designed to sow fear among workers,” United and Progressive Workers Center (SENTRO) Secretary General Josua Mata told the Solidarity Center.

Persecution has not stopped despite recent changes to the government’s top leadership. Union leader Jude Thaddeus Fernandez, 67, was killed September 29 after a division of the Philippine National Police reportedly entered Fernandez’s home and shot him dead. The murder of Alex Dolorosa—whose role as a union organizer and a paralegal was funded by the Communications Workers of America (CWA)—in April remains uninvestigated like every other extrajudicial killing of a trade unionist in the country.

Workers who are organizing and conducting other union business in the Philippines seek only to build a decent society and life for their families, Trade Union Congress of the Philippines (TUCP) Vice President Luis Corral told the Solidarity Center.

“We are not the enemy,” he said.

In addition to Corral and Mata, the delegation receiving the award for include Alliance of Concerned Teachers (ACT) Secretary General Raymond Basilio; Business Process Outsourcing Industry Employees Network (BIEN) President Mylene Cabalona; Public Services Labor Independent Confederation (PSLINK) President Annie Enriquez Geron; Kilusang Mayo Uno (KMU) Chairman Elmer Labog; and Federation of Free Workers (FFW) President Sonny Matula. The Solidarity Center has a 25-year partnership with the Philippine labor movement, including current support for an organizing campaign for low wage, app-based food delivery workers. 

“This recognition fortifies our resolve and validates our efforts under the most challenging of circumstances,” said TUCP President and Philippine Congress House Deputy Speaker Raymond Mendoza when accepting the award, “on behalf of all workers in the Philippines, especially those who gave their lives for labor.”

Previous award recipients include United Nations Special Rapporteur on the rights to freedom of peaceful assembly and of association Maina Kiai and the Tunisian General Labor Union (Union Générale Tunisienne du Travail, UGTT), which also won a shared Nobel Peace Prize for its role in brokering Tunisia’s path to democracy during the Arab uprisings.

A new survey—the first in Ukraine to evaluate domestic workers’ working conditions—found that working without contracts and formal recognition has left most survey respondents victim to low pay, wage theft, confusion about employment status, exclusion from the country’s pension system and minimal capacity to exercise their right to freedom of association.

“What kind of pension will we have? God grant that it will be at all,” said survey respondent Kateryna (last name withheld for privacy).

Survey results documenting the pitfalls of domestic worker informal employment was presented to an in-person and virtual gathering of domestic workers, employment agencies and national union representatives last month. Survey results presented to event attendees—who included representatives of the new domestic worker organization, United Home Staff (UHS) and Tetiana Tsyba, Ukraine Member of Parliament and head of the parliamentary working group on proposed domestic worker law Number 5695.

Most survey respondents reported working without the legal protections and pension benefits afforded to formally recognized workers. While some were employed under various forms of contracts—including employment agency contracts (5 percent), civil law contracts (12 percent) or employment contracts (22 percent)—more than 60 percent said they were working without formal terms and conditions of employment.  

Additional findings include:

  • Almost 60 percent reported wage theft or insufficient compensation for work performed.
  • Almost half said they do not get pay increases for overtime or weekend work; a quarter said their employer encourages overtime work without additional pay.
  • Almost half said they do not receive paid vacation time.
  • 60 percent were unaware of trade unions or other organizations that can represent or otherwise assist domestic workers.
  • Most (69 percent) have worked informally throughout their careers, making them ineligible for Ukraine’s pension system.

Many internally displaced people who lost work because of war have become domestic workers, including those previously employed as university professors and schoolteachers. Of those surveyed, more than 60 percent working without a contract reported lower wages during wartime.

The survey was sponsored by the Ukraine nongovernmental worker rights organization Labor Initiatives (LI), to raise awareness of challenges in the sector for workers, support the country’s legislative efforts to formalize domestic work and encourage unions to organize domestic workers. With Solidarity Center support, LI supplies legal and other assistance to Ukraine’s workers and unions.

Sexual harassment and other forms of gender-based violence are rampant in garment factories in Bangladesh and throughout the textile production and retail industry in South Africa, according to two recently published Solidarity Center reports. The sample surveys are among a broad spectrum of outreach by Solidarity Center partners who also are addressing gender inequities through awareness efforts among informal economy workers and workers with disabilities in Nigeria, in labor rights and career workshops in Armenia and Georgia, and among app-based drivers in multiple countries.

In addressing the root causes of GBVH in the world of work, a priority for the Solidarity Center, workers and civil society join together to advocate collectively beyond the workplace to push for policy and legal reform, expanding democracy.

November 25 marks the start of 16 Days of Activism Against Gender-Based Violence, an annual  international campaign in which union activists stand in solidarity with women’s rights activists to highlight the prevalence of GBVH at the workplace and to support feminist movements around the world in calling for a world free from GBVH. The campaign culminates on December 10, Human Rights Day.

As activists mobilize worldwide, here’s a snapshot of how Solidarity Center and its partners are moving forward efforts to end GBVH at the workplace and achieve decent, inclusive work for all.

Garment Industry: Rife with GBVH

Bangladesh garment workers, standing up to gender-based violence at work with their unions, Solidarity CenterBecause so little data exists on the prevalence of GBVH at workplaces, union activists and their allies in Bangladesh and South Africa sought to document workers’ experiences at garment factories and clothing outlets. Solidarity Center partners previously conducted similar studies in Cambodia, Indonesia and Nigeria.

In South Africa, 98 percent of the 117 workers surveyed said they had experienced one or more forms of GBVH at work. The Bangladesh survey found severe outcomes for workers who experienced GBVH at work, with 89 percent saying they “broke down mentally” and 45 percent reporting leaving their jobs temporarily and/or losing pay. The survey involved 120 workers in 103 garment factories and was conducted by 21 activists from grassroots and worker organizations.

In many cases, workers’ jobs and wages were at risk if they did not agree to sex with employers or managers. In Bangladesh, 57 percent of survey participants said they lost their jobs because they refused such overtures. As one survey participant in South Africa said:

“My manager called me to his office and said that if I want to extend my hours of work, I must go out with him. He kept on asking, even forcefully and aggressively … I heard from other women workers that he had also asked them.” Survey participants were not identified for their safety.

Both surveys were conducted through participatory action research, rooted in collaboration, education, developing skills and centered on a “Do No Harm” ethos to avoid re-traumatizing interviewees. Through worker-driven strategies to address and prevent GBVH in the garment sector, the processes created a set of recommendations including urging employers to enforce zero tolerance policies for GBVH and for unions to prioritize GBVH prevention and make women worker safety a core union priority.

Key to the recommendations is ratification and enforcement of an international treaty on ending violence and harassment at work. Convention 190 was approved by the International Labor Organization (ILO) in 2019 after a decade-long campaign led in part by the Solidarity Center and its partners. C190 now must be ratified by governments, and union activists are mobilizing members and allies in ratification campaigns that include awareness-raising about GBVH at work. South African unions, led by the Congress of South African Trade Unions (COSATU), successfully pushed for ratification in 2021. 

Reaching Marginalized Workers

In Nigeria, union activists are using awareness raising to address the intersecting challenges facing workers with disabilities who also experience GBVH and gender discrimination at work. Through a weekly radio program and public service ads, the program elevates the voices of workers with disabilities who already are marginalized because of their status, providing a platform where they discuss their concerns around GBVH and access to equal rights to work and pay.

The program stems from recommendations in a survey of more than 600 workers with disabilities in Nigeria by the Trade Union Congress of Nigeria (TUC) to create mass awareness of disability rights and GBVH. 

The radio program also is an avenue to reach workers in Nigeria’s large informal economy. Following the adoption of C190, union leaders at the Nigeria Labor Congress (NLC), with Solidarity Center support, began training vendors at the sprawling Mile 12 market in Lagos. The vendors formed a GBVH task force that worked with the NLC to develop a market code of conduct covering gender-based violence and harassment and helped raise awareness among vendors about their rights to a violence-free workplace. 

Their outreach resulted in the identification of multiple cases of rape and sexual assault against minors, who often assist their parents in the market. Five people have been arrested and now are awaiting trial for allegedly violating the rights of children between 9 and 14 years old, said Agnes Funmi Sessi, NLC Lagos State Council chairperson.    

Building Leadership Skills, Building Power

Building leadership and power within historically marginalized populations to take on issues and traditional hierarchies is a key part of Solidarity Center’s focus on ensuring equality and inclusion at the workplace. 

In Armenia and Georgia, young women workers are learning crucial employment skills as part of Strengthening Women’s Participation in the Workforce, a Solidarity Center-supported program in partnership with professional networks and other civil society organizations. The project seeks to increase women’s full, equal and safe participation in the workforce, including vulnerable women workers’ access to decent work. Training sessions include exposure to science, technology, engineering and mathematics (STEM) professions and other career development, and cover labor rights, including the right to a safe and healthy workplace. The programs reach women in rural areas, many of whom are marginalized with limited access to job opportunities and skills building.

In Armenia, where the project operates as the Women Professional Empowerment Network (WPEN), young women take part in an interactive exchange that fosters the development of a supportive network and includes upskilling and raising awareness of employment opportunities, along with advice and guidance about the most in-demand new careers.

Addressing GBVH is an essential part of campaigns mobilizing app-based drivers to achieve their rights on the job, including the freedom to form unions, as the safety risks they face every day are especially compounded for women platform workers.

“Not just in Colombia, but worldwide, women are always the ones that are the most vulnerable and paid the worst,” Luz Myriam Fique Cárdenas told participants earlier this year at a Solidarity Center-sponsored event, Women Workers Organizing: Transforming the Gig Economy through Collective Action. “We suffer harassment. We don’t have security in the streets because we’re women,” said Cárdenas, president of Unión de Trabajadores de Plataformas (Union of Platform Workers, UNIDAPP) in Colombia. 

Recently in Mexico, the Solidarity Center hosted women delivery drivers from seven countries in Latin America and in Nigeria. The eight unions participating agreed on five key gender-focused points for inclusion in the Convention on Decent Work on Digital Platforms now being drafted for consideration by the ILO. The women leaders at the Alza La Voz (Raise Our Voice) forum are planning a joint campaign to ensure the convention addresses the specific challenges women app-based workers face. 

As throughout the campaigns to end GBVH at work, women app-based drivers are finding strength in joining together and experiencing the power to improve working conditions through collective action.

“We have to create alliances,” Shair Tovar, gender secretary of the National Union of Digital Workers (UNTA) in Mexico, told participants. “Women can achieve enormous things together.”

In response to the unveiling of the Biden administration’s Presidential Memorandum on Advancing Worker Empowerment, Rights and High Labor Standards Globally, Solidarity Center Executive Director Shawna Bader-Blau issued the following statement:

“The Biden administration’s announcement today represents the first time the U.S. government has made a holistic commitment to global worker rights. If this new global labor strategy is fully resourced and implemented, the United States has a historic opportunity to play a critical role in reversing corporate- and government-supported exploitation of millions of working people and bolster democratic freedoms around the world. 

“It is impossible to overstate the need for this long-awaited commitment to worker rights. In many countries where the United States has diplomatic, trade and economic development influence, workers’ ability to exercise everyday democracy—through the rights to form and join unions, strike and bargain together for fair wages and decent working conditions—is consistently repressed, often violently and sometimes fatally. In just the past two months, police allegedly shot and killed three garment workers and injured many more during protests for a higher minimum wage in Bangladesh; entered a labor union leader’s home in the Philippines, shooting him dead; and assaulted workers in Nigeria protesting over lost wages, seriously injuring the union’s leader. This new strategy to advance global labor rights is a roadmap for the U.S. government to expand its use of diplomatic and trade leverage and multilateral tools and settings to garner additional countries’ support for upholding worker rights.

“The U.S. government should use its direct influence or its convening power with other nations to address labor rights repression in places like Belarus and Myanmar, where unions fighting for democracy have been outlawed by their governments, their leaders and members beaten, jailed, sent into exile or killed. 

“This all-of-government labor rights strategy should also focus on influencing labor laws and increasing employer accountability. Today, U.S. companies too often treat sourcing like a game of Whac-A-Mole, jumping from country to country when strengthened and enforced labor laws drive workers’ pay closer to a living wage. And, most of the 2 billion people who work in the informal economy, including agriculture and domestic workers, street vendors and drivers and delivery workers in the growing platform economy, have no access to health care, sick leave or support when they are injured or lose their jobs. 

“The Biden administration’s trade approach in Mexico has the potential to be a game-changer for workers and an example of this new labor strategy’s potential impact. The U.S.-Mexico-Canada Agreement includes a rapid response complaint mechanism unions are using to remedy worker rights abuses. Tying worker rights to U.S. market access and investing in independent union organizing has led to an unprecedented growth of democratic unions that represent workers’ interests and are winning wage hikes and safety improvements in factories that supply the U.S. market. Replicating this kind of approach to worker-centered trade policy should be a priority.

“We are hopeful that this commitment to global labor rights will mean workers are represented in conversations about how to sustain good union jobs in communities worldwide that are most impacted by the transition to a clean energy economy. We look forward to workers’ rights and livelihoods becoming front-and-center in conversations about the evolution of technology in the workplace. And, we look forward to expanded investment and prioritization of a worker rights approach to ending gender-based violence and harassment and other forms of exploitation on the job.”
